EU Digital Omnibus on AI (Regulation (EU) 2026/1744): AI Act high-risk dates postponed, machinery AI moved to the Machinery Regulation

Regulation (EU) 2026/1744 of 8 July 2026 amends the AI Act (Regulation (EU) 2024/1689), the Machinery Regulation (EU) 2023/1230 and the EU aviation safety regulation. It entered into force on 27 July 2026. Status: in force.

What it changes: high-risk obligations for stand-alone (Annex III) AI systems now apply from 2 December 2027 instead of 2 August 2026, and high-risk obligations for AI that is a safety component of products under the Annex I product laws now apply from 2 August 2028. The Machinery Regulation moves from Section A to Section B of AI Act Annex I, so AI safety components in machinery are not assessed separately under the AI Act; instead the Commission must adopt delegated acts by 2 August 2028 adding AI-specific health and safety requirements into the Machinery Regulation.

Until then, manufacturers may rely on harmonised standards or common specifications adopted under the AI Act for a presumption of conformity. It also adds prohibitions on AI systems generating non-consensual intimate imagery or child sexual abuse material, applying from 2 December 2026. Applicability: this is the change most relevant to humanoids, mobile manipulators and AMRs sold in the EU, because their AI-driven safety functions now route through machinery law rather than the AI Act's separate high-risk regime. Verified on 2026-10-26.
