Maryland Data Center Accountability Task Force EO (25 MW+ / Large Load; Aligned/Conditionally Aligned/Not Aligned; not a statewide moratorium)

On Sep 23 2026, Maryland Gov. Wes Moore signed an executive order creating the Maryland Data Center Accountability Task Force and a statewide review framework for large data center projects (generally projected or actual peak electric demand of 25 MW or more, and facilities qualifying as Large Load under Maryland utility law) when seeking state permits, incentives, letters of support, or other discretionary state action.

Projects are evaluated against five principles (ratepayer and grid protection; economic benefits for Marylanders; community voice; environmental protections; transparency and accountability) and designated Aligned, Conditionally Aligned, or Not Aligned. Aligned/Conditionally Aligned projects can use a Coordinated Review Pathway; Not Aligned / non-submitting projects face deferred substantive state review and lose discretionary state support/advocacy.

The order directs a public Maryland Data Center Dashboard and bars executive agencies from entering into or renewing new NDAs with data center developers (existing NDAs honored until expiration). NOT a statewide construction moratorium. Cap: Moore has separately said he would support a legislative statewide data-center moratorium if the General Assembly passed one (WYPR citing Punchbowl); that is outside this EO. The administration also continues seeking repeal of the 2020 data-center sales-and-use tax exemption via the legislature.
