Oakland, California adopts a 45-day urgency moratorium on approvals for new data centers (File 27-0050)

On October 6, 2026 the Oakland City Council voted 7-0 to adopt an interim urgency ordinance under California Government Code Section 65858 (File 27-0050), sponsored by Councilmember Carroll Fife, establishing a temporary moratorium on the approval of any land use entitlements or agreements allowing the development or operation of data centers in the city. It took effect immediately and lasts 45 days; an extension requires Council approval.

During the moratorium the city will not issue building, occupancy or conditional use permits, variances, zone changes or other entitlements for data centers while staff study impacts on power, water and air quality and draft regulations. It was adopted the same week as San Francisco's 45-day moratorium.
