Texas Governor directs TCEQ to halt all permits sought by data centers until the ERCOT audit is complete

On September 21, 2026 Governor Greg Abbott directed the Texas Commission on Environmental Quality (TCEQ) to halt all permits sought by data centers until the Electric Reliability Council of Texas (ERCOT) completes its audit, and said no state agency shall move forward with regulatory approvals related to data center development until the PUCT, ERCOT and Texas Water Development Board (TWDB) have the information they require. The directive builds on the August 2026 PUCT and ERCOT interconnection audit and a September 14 directive to TWDB on water-use reporting.

The Governor's office said data centers must cover their electrical infrastructure costs, report electricity and water use and meet setback requirements, that TCEQ must report on its compliance by October 19, 2026, and that the Governor will seek to eliminate data center financial incentives next legislative session.
